SMSGlobal Acceptable Use Policy
This Acceptable Use Policy (“AUP”) applies to Customer’s use of services offered by SMSGlobal. Compliance with the AUP is mandatory for continued usage of SMSGlobal services.
This AUP will be updated periodically; please ensure you read and understand what this means.
Prohibited Usage
The customer agrees not to use, allow or encourage any End User to use the services in the following prohibited ways:
Using the services in a manner that is illegal, fraudulent, sending spam or unsolicited communications or engaging in abusive activities;
Using the services in a manner that interferes with the SMSGlobal or its customer's business activities;
Using the services illegally or inappropriately that generates inquiries from regulatory and law enforcement;
Transmitting any data or content that contains viruses, Trojan horses, spyware, worms or other harmful or malicious programs.
Using the services to illegally collect information of individuals without their explicit consent;
Using the services in a manner that causes a service provider to ban such usage or materially;
Using the services in any manner that violates a) privacy laws, b) codes and guidelines, and service standards issued by a Governmental agency; c) all other laws, including Spam Act 2003, rules and regulations in any relevant jurisdiction (including Australia);
Using the services in an excessive manner, especially to mediate heavy usage that may affect the services of other customers on the network as a result of excessive usage, including but not limited to speed management or bandwidth allocation management and call barring; and/or
Using the services in a manner that is deemed excessive, especially in regard to voice services. In this case, SMSGlobal reserves the right to review and subsequently terminate the all-inclusive call packages if it is suspected that Customer usage is deemed excessive.
Sender IDs & Alphnumeric IDs
This policy sets out the acceptable use of Sender IDs or Alphanumeric within the Australian SMS industry. The use of Sender IDs or Alphanumeric must comply with the following restrictions:
- Legality: The use of Sender IDs or Alphanumeric must not contravene any laws or regulations, including but not limited to, the Spam Act 2003, the Australian Communications and Media Authority (ACMA) Do Not Call Register Act 2006 and the Telecommunications Act 1997.
- Appropriate Content: The content of SMS messages must not be harmful, offensive, obscene, threatening, harassing or otherwise inappropriate.
- Accuracy: Sender IDs or Alphanumeric must accurately reflect the message's source and not be misleading or impersonating any person, organisation or entity.
- Opt-Out Mechanism: SMS messages must include an opt-out mechanism allowing recipients to unsubscribe from future messages.

- Frequency: The frequency of SMS messages must not be excessive or cause undue inconvenience to the recipient.
- Permission-Based Marketing: The recipient of the SMS message must have given permission for the sender to send marketing messages to their mobile number.
Consequences for Misuse or Policy Violations:
Suspension or Termination of Services: In the event of a breach of this policy, the service provider reserves the right to suspend or terminate the sender's account without prior notice.
Legal Action: In the event of a breach of the law, SMSGlobal may cooperate with law enforcement agencies and take legal action against the sender.
Reputation Damage: Misuse of Sender IDs or Alphanumeric may damage the reputation of both the sender and the service provider.
It is the responsibility of the sender to comply with this policy. SMSGlobal reserves the right to amend this policy at any time without prior notice. Continued use of Sender IDs, Alphanumeric or any of SMSGlobals products or services constitutes acceptance of the terms and conditions outlined in this policy.
